§ 1-8.1. Waiverable offenses.
(a)
Definitions.
(1)
"Waiverable offense" means a non-criminal violation of a municipal ordinance.
(2)
"Minimum civil penalty" means the fine established as the minimum penalty for individual municipal ordinance violations as determined by municipal resolution.
(3)
"Juvenile deferred prosecution program" means the program developed to defer first-time juvenile offenders of misdemeanor and city ordinance violations from the court system.
(b)
Court appearance not required. Any person issued a municipal citation for a waiverable offense may avoid a court appearance by:
(1)
Payment of the minimum civil penalty established by municipal resolution;
(2)
Payment of said minimum civil penalty within ten (10) working days from the date of citation; and
(3)
Payment shall be made at the address specified on the citation. Payment by U.S. mail must be posted within ten (10) working days of the citation issuance.
(4)
Selection to participate in the juvenile deferred prosecution program.
(c)
Exception, mandatory court appearance required. A mandatory court appearance may be required where the person cited demonstrates, in the opinion of the officer issuing the citation, a reckless disregard or flagrant indifference to the rights and/or safety of persons or property in committing the offense or such person is issued a repeat citation for violation of the same ordinance within a twelve-month period.
(d)
Minimum civil penalty. The minimum civil penalties for non-criminal violations of municipal ordinances are set forth below:

(e)
Schedule of fines for the second and subsequent violation. The county court system in its review and adjudication of matters shall follow this schedule of fines. (f)
Maximum civil penalty. The maximum civil penalty for all non-criminal violations of municipal ordinances shall be five hundred dollars ($500.00) unless otherwise specified by law.
