§ 4-5. Regulations pertaining to animals generally.
(a)
It shall be unlawful for any person or owner having custody or control of an animal, to permit that animal to bark, whine, howl, honk, bray, cry, squawk, crow, or make other noise excessively so as to disturb the sleep, peace, and tranquility of any inhabitant of the city. However, it shall not be a violation of this section for any animal, bird, or fowl to give a sound of danger or warning in accordance with its nature or training under particular circumstances reasonably causing it to do so.
(b)
It shall be unlawful for any person who owns or has control of any animal to permit said animal to defecate upon the following, unless said person has on his or her person a means to immediately remove any feces of such animal:
(1)
Any street, sidewalk or alley of any public or private property, or
(2)
Any public park, parkways, roadways or school ground, other than areas designated for that purpose, or
(3)
Any private property not belonging to the owner of the animal, or
(4)
Any swale, easement, or right-of-way serving to convey stormwater to a canal, lake, or other receiving water.
For the purpose of section 4-5(b), the means of removal shall be any tool, implement, or other device carried for the purpose of picking up and containing such feces, unexposed to said person or the public. Disposal shall be accomplished by transporting such feces to a place appropriate for the sanitary disposal of such feces.
(c)
The owner of any animal shall keep his or her own property free of animal excrement to the extent that is necessary to prevent noxious or offensive odors from escaping onto adjacent property or public right-of-way.
(d)
It shall be unlawful for the owner of any animal to tie, chain, or otherwise tether the animal in such a manner that it has access to public property or the property of another without the consent of the owner of such property.
(e)
Any animal found by an officer to be at large may be seized and impounded; as an alternative or in addition to impoundment, the officer may issue a citation.
(f)
All animals kept outdoors shall have access to shelter that provides protection from the weather; i.e., wind, precipitation, or other inclement weather conditions, and provides shade from the sun during hot weather. Shelter shall meet the requirements of section 4-16 of this chapter.
