§ 11-26. Unauthorized take off or landing of aircraft from real property prohibited.
(1)
The term "aircraft" as used in this section shall mean any motor vehicle or contrivance now known, or hereinafter invented, which is used or design[ed] for navigation of or flight in the air capable of carrying human passengers, except a parachute or other contrivance designed for such navigation but used primarily as safety equipment.
(2)
It shall be unlawful for any person to take off or land any aircraft within the corporate limits of the city except from or upon an established and licensed airport, heliport, helistop site or as otherwise provided herein.
(3)
It shall be unlawful for any owner or lessee of real property to permit any person to take off or land any aircraft within the corporate limits of the city except from or upon an established and licensed airport, heliport, helistop site, or as otherwise provided herein.
(4)
Exemptions: The provisions of this section do not apply to:
(a)
Any law enforcement agency, fire department and dignitaries of the federal, state or local government actively engaged in the performance of its official duties and dignitaries of state, local or federal governments.
(b)
Members of the news media actively engaged in the performance of their official duties or aircraft operated in conjunction with a charitable fund raising event hosted by or on behalf of the City, or non-profit charitable organizations with tax exempt status under Section 501(c)(3) of the Internal Revenue Code; provided that any such person or entity receives prior written approval in the form of a permit issued by the Coral Springs Police Department and the operation of such aircraft is in strict accordance with the terms and conditions of such permit.
(c)
Any person, firm, corporation or association licensed as an air ambulance service pursuant to the requirements of Chapter 401.48 (1991) as amended from time to time, and engaged in the transportation by air ambulance of persons who may need medical attention.
(d)
Any person operating an aircraft under emergency conditions where the land or take off of the aircraft is necessary to protect against a clear and imminent danger to human life.
(5)
Any person or corporation who is exempt from the provisions of this section, except for those persons or entities listed in paragraph (4)(a) and (b) above and who lands or takes off an air-craft as authorized hereunder, shall, as soon as is practicable under the circumstances, notify the Coral Springs Police Department of the landing or take off, location of the landing or take off, description of any personal injury, death or property damage caused thereby, and any other pertinent information as required by the Coral Springs Police Department. Failure to give such notification shall be deemed a separate violation of this section.
