§ 18-9. Prohibition of major automobile repairs in residential areas.

  • (a)

    Definitions.

    (1)

    Vehicle repair, minor. Repair of any vehicle of less than ten thousand (10,000) pounds gross weight, said repairs to include, but not be limited to, the following:

    a.

    Tune-ups;

    b.

    Lights;

    c.

    Changing fluids;

    d.

    Starters;

    e.

    Alternators;

    f.

    Replacement of belts;

    g.

    Routine adjustments;

    h.

    Tire changes.

    (Maximum time allowed for minor repairs is one (1) day.)

    (2)

    Vehicle repair, major. Major automobile repairs should include, but not be limited to the following:

    a.

    Internal engine repair;

    b.

    Rear end repairs;

    c.

    Transmission repairs;

    d.

    Brake repairs;

    e.

    Exhaust system repairs;

    f.

    Body work;

    g.

    Frame-straightening;

    h.

    Rebuilding and/or reassembly.

    (b)

    Prohibition. All major vehicle repairs are prohibited within the residential areas of the city.

    (c)

    Exception. Nothing contained within this section shall prohibit any individual from performing any repairs on their personal vehicles within a residential garage or performing light vehicle repairs (as defined herein) within the residential areas of the city.

    (d)

    Violations, liability for payment. The owner of a vehicle cited for violation of this section shall be responsible and liable for payment of any tickets unless the owner can furnish evidence that the vehicle was, at the time of the violation, in the care, custody or control of another person. In such instances, the owner of the vehicle is required, within a reasonable time after notification of the violation, to furnish to the appropriate law enforcement authorities, an affidavit setting forth the name, address, and driver's license number of the person or company who had the care, custody or control of the vehicle. The owner of a vehicle is not responsible for the violations if the vehicle was, at the time stolen or in the care, custody, or control of some person who did not have permission of the owner to use the vehicle.

    (e)

    Ticketing procedure. Vehicles found in violation of this section shall be ticketed by code enforcement officers of the City of Coral Springs or by the Coral Springs Police Department, said ticket to be given to the person performing said major vehicle repairs, or in the absence of such a person, said ticket shall be affixed to the windshield of the offending vehicle.
