§ 8-33. Enforcement and penalties.
(a)
Fines.
(1)
Any person convicted by a court of competent jurisdiction of a violation of sections 8-30, 8-31 or 8-32 shall be subject to the imposition of a fine in the amount not to exceed five hundred dollars ($500.00).
(2)
Any person convicted by a court of competent jurisdiction of a violation of section 8-29 involving the dumping of litter, for a non-commercial purpose, excluding hazardous waste, in an amount not exceeding fifteen (15) pounds in weight or twenty-seven (27) cubic feet in volume shall be fined an amount of fifty dollars ($50.00).
(3)
Any person convicted by a court of competent jurisdiction of a violation of section 8-29 involving the dumping of any one of the following types of litter shall be subject to the imposition of a fine in an amount not less than fifty dollars ($50.00) and nor more than five hundred dollars ($500.00):
a.
Litter in an amount which exceeds fifteen (15) pounds in weight and twenty-seven (27) cubic feet in volume.
b.
Litter in any amount dumped for commercial purposes.
c.
Litter in any amount which constitutes a hazardous waste or bio-hazardous waste.
(b)
Restoration; restitution; public services. In addition to the imposition of a fine for a violation of section 8-29, the court may impose civil penalties upon the violator including any one or more of the following:
(1)
Order the violator to remove the litter dumped in violation of the article.
(2)
Order the violator to repair or restore any property damaged or destroyed by his dumping of litter in violation of this article.
(3)
Order the violator to pay the injured party damages caused by his dumping litter in violation of this article.
(4)
Order the violator to pay the city or the injured party the cost of removal and proper disposal of litter.
(5)
Order the violator to perform public service commensurate with the offense.
(c)
All violations of this chapter shall be enforced as directed in Chapter 1, Article V, of the Land Development Code of the Code of Ordinances, entitled "Code Enforcement Board and Special Masters."
