§ 8-34. Presumptions and burden of proof.

(a)
In any prosecution or trial of any person charged with violating the provisions of section 8-29(a)(4), the violator shall have the burden of proving, as an affirmative defense, that he had the consent of the property owner.
(b)
In any prosecution or trial of any person charged with violating the provisions of section 8-29(b), there is a rebuttable presumption that litter dumped from a commercial vehicle was dumped for commercial purposes.
