§ 6-16. Declaration of intent.

  • (a)

    The city commission has publicly read, reviewed and analyzed Ordinance No. 93-174 and Section 4.09 of the City's Charter and has accepted the recommendations and legal analysis of the City's Special Outside Counsel, David E. Cardwell, Esquire, in addition to public comments and input, and points of clarification and evaluation by members of the city commission in office on the date of enactment of this Section 6-16 or also in office on the adoption date of the ordinance and the resultant addition to the City's Charter of Section 4.09 at the March, 1994 election.

    Based upon such public review and consideration, this city commission hereby states the legislative declaration of its intent, purpose and direction for clarification of Ordinance No. 93-174 and Section 4.09 of the City's Charter as follows:

    (1)

    Section 4.09 of the City's Charter which was approved by the electorate of the City of Coral Springs in March, 1994, and in particular, reference to "all persons elected to service on the city commission on and after March, 1996, shall be limited to eight (8) consecutive years in service on the city commission" shall apply to elected members of the city commission prospectively from the year 1996. Hence, persons elected to the city commission in 1996 shall be entitled to eight (8) consecutive years of service on the city commission, if elected. Persons elected to city commission in 1998 shall be entitled to eight (8) consecutive years of service, if elected.

    The following sequence shall apply given the interpretation and public declaration of intent of the city commission:

    a.

    The first full term to which an individual serving on the city commission was elected on and after March, 1996 shall be:

    (1)

    Seat No. 1 (Mayor John Sommerer), elected March 1996: term limit expiring March, 2004;

    (2)

    Seat No. 3 (Alan Polin), elected March, 1996; term limit expiring March 2004;

    (3)

    Seat No. 5 (Vice Mayor Maureen Berk), elected March, 1996; term limit expiring March, 2004;

    (4)

    Seat No. 2 (Bill Stradling), elected March 1998; term limit expiring March, 2006; and

    (5)

    Seat No. 4 (Rhonda Calhoun), elected March, 1998; term limit expiring March, 2006.

    b.

    It is the express purpose and intent of this section to preserve and to protect the staggering of elected terms of office to the city commission consistent with the City's Charter in Section 4.02.

    (b)

    Upon the enactment of this section, each member of the city commission is fully advised of the rights, responsibilities and obligations to fulfill the terms, conditions and provisions of this section and to support the declaration of intent contained herein for the health, safety and welfare of the citizens and residents of the City of Coral Springs.

    (c)

    Nothing contained in this section is intended to abrogate, modify or change any other section of the City's Charter, Code of Ordinances, Resolutions or policies of this city commission as set forth and described in this ordinance as it applies to the limitation on terms of office for commission members described in Section 4.09 of the City's Charter.
