§ 7-179. Responsible parties; payment for discharge costs.

  • (a)

    The responsible party who causes or allows the discharge of hazardous substances which requires action by the fire department of the city or its authorized agents in order to protect the public health, safety or welfare shall be jointly and severally liable to the city for the costs incurred by the city in investigating, mitigating, minimizing, removing and abating any such discharge.

    (b)

    The responsible party who causes or allows the discharge of hazardous substances shall reimburse the city for the full amount of all costs of such discharge. Payment shall be made within a period of thirty (30) calendar days after receipt of an itemized bill for such costs from the city.

    (c)

    The responsible party who causes or allows the discharge of hazardous substances and who fails to reimburse the city within the time set forth in section 7-179(b), shall be brought before the code enforcement board to ensure compliance.
