Article IX. CORAL SPRINGS VOLUNTEER FIREFIGHTERS' PENSION PLAN |
§ 7-190. Definitions.
Wherever used herein, the following terms shall have the following meanings:
(a)
Accrued benefit means the benefit to which a participant is entitled under the plan, subject to the vesting schedule described in section 7-193(a), the amount of which shall be the sum of (i) plus (ii) where:
(i)
Equals six hundred forty-eight dollars ($648.00) multiplied by the number of the participant's years of credited service earned prior to January 1, 1990, to the extent funded; and
(ii)
Equals six hundred forty-eight dollars ($648.00) multiplied by the number of the participant's years of credited service earned on or after January 1, 1990.
The amounts described in subsections (i) and (ii) shall be adjusted for gains and losses as described in section 7-194. In the event that the total years of credited service under subsections (i) and (ii) exceed thirty (30), the participant shall continue to be credited with years of service under subsection (ii) and the years of credited service under subsection (i) shall be reduced accordingly so that the total shall never exceed thirty (30).
(b)
Administrator means the individual or entity appointed by the city to administer the plan as agent for the city.
(c)
Beneficiary means the individual or entity designated as such by the participant pursuant to the plan or otherwise entitled to receive any payment pursuant to the plan as a result of the death of the participant. If with respect to any payments no such designated beneficiary survives the participant, the participant's beneficiary with respect to such payment shall be his spouse, if living at the time of such payment, or in default thereof, his surviving issued, per-stirpes, or in default thereof, his estate.
(d)
City means the City of Coral Springs, Broward County, Florida.
(e)
Effective date means the effective date of the plan, which date is January 1, 1990.
(f)
Participant means an individual who is eligible for participation in the plan in accordance with section 7-191, including a former participant who has not received a distribution of his vested accrued benefit.
(g)
Plan means the City of Coral Springs Volunteer Firefighters' Pension Plan, as set forth herein and as it may be amended from time to time.
(h)
Plan year means each twelve (12) consecutive month period ending December 31.
(i)
Retired volunteer firefighter means a volunteer firefighter who is no longer in service as of January 1, 1990, and who has completed at least six (6) years of credited service prior to January 1, 1990.
(j)
Service means the relationship of an individual with the city as a volunteer firefighter.
(k)
Trust means the City of Coral Springs Volunteer Firefighters' Pension Trust.
(l)
Trust fund means the assets of the fund.
(m)
Trustees means the person or persons acting as trustee or trustees under the trust at any time or from time to time.
(n)
Valuation date means the last day of the plan year and such other dates as the trustees shall determine.
(o)
Volunteer firefighter means each individual designated as a volunteer firefighter by and for the city.
(p)
Year of credited service means a calendar year during which a volunteer firefighter:
(i)
Completed a minimum of five hundred seventy-six (576) shift hours and one hundred forty-four (144) training hours per calendar year beginning on January 1, 2000 and thereafter with the exception that fire prevention members are exempt from the annual training hourly requirement; or
(ii)
Responded to at least twenty (20) per cent of fire calls and special assignments between April 23, 1970, and December 31, 1989, and thirty (30) per cent between January 1, 1990 and December 31, 1994; and twenty-five (25) per cent between January 1, 1995 and December 31, 1999; or
(iii)
Served at least two hundred sixteen (216) hours between April 23, 1970, and December 31, 1989, and three hundred (300) hours between January 1, 1990 and December 31, 1994, and two hundred eighty (280) hours between January 1, 1995 and December 31, 1999.
A year of credited service shall not be deemed interrupted by termination of volunteer status with the city, if a volunteer firefighter resumes volunteer service with the city within one (1) year of said termination.

It should be noted that section 2 of Ord. No. 2002-110 amended § 7-190(p)(i) to read as herein set out. Section 3 of said ordinance provides, "This Ordinance shall be retroactive to January 1, 2000 for volunteers in active status on or after October 11, 2000." See the Code Comparative Table.
